Beklagte vor Anfang des Processes bei dem betreffenden Gerichtshofe niederlegen mußten, das sacramentum der Römer; wer den Proceß verlor, ging nicht bloß seines Geldes verlustig, sondern mußte auch dem gewinnenden Theile das seinige ersetzen. Bei solchen Processen, die auf 100 bis 1000 Drachmen geschätzt waren, betrug es 3 Drachmen für jeden Theil, bei einer Sache von 1001 dis 10, 000 Drachmen 30 u. s. f., vgl. Dem. 43, 71 im Gesetz.
